Yet Another OIPCBC Update…….
I cannot fail to note that this is, in fact, the third time extension asked for and granted. In baseball its three strikes and you are out. I cannot help but wonder how much time and effort is being spent by Nanaimo taxpayers on this matter.

To the Parties,
The public body has contacted me a second time indicating that it is again having difficulty getting in contact with an out of town affiant, and has asked for a further week’s extension. They have offered to give up one week at the end of the inquiry for their final reply submission. I will grant this one further extension on the condition that they will receive only one week to provide a reply to the applicant’s response submission. I will also grant the same time extension to the applicant.
The amended schedule is as follows:
Public body’s initial submission: May 7, 2015
Applicant’s response submission: May 29, 2015
Public body’s reply submission: June 5, 2015
Please note that I will not accept any further adjournment requests for this file.

Tomorrow should be the day when the City’s response to my objection to the redaction of public records arrives. See the correspondence below. I find it ironic that the document provided as a response to my objection to the redaction of public records should itself be redacted. But ….

As I have been informed that I will receive the response from the City’s legal representative by courier tomorrow, I wish to clarify the situation with regard to the ways in which the material received can be made public. I have thus far made public all the material related to this matter on my blog and propose to do so with both the material received as well as my response to it unless there is some legal impediment. Your note of April 23, seemed to me to be ambiguous on this point. Will the redacted information simply be missing to me, thus meaning that I am free to publish as received, or will there be any difficulties in this area.

Dear Mr. Bolin,
There is no action required on your part. Material that is submitted as proposed for in camera is considered by an adjudicator. It is scrutinized very carefully and only approved on the very strict conditions that it would either; 1) reveal some or all the record at issue, or; 2) portions may be protected from disclosure under a section(s) of FIPPA.
It is very important to the OIPC that in camera material is kept to a minimum as it restricts the adjudicator from being able to give reasons in his or her order as to how and why he/she came to their conclusion regarding that particular material. I can assure you that the adjudicators are very careful in what they allow to be held in camera.
We do not share the adjudicator’s review with the applicant as the decision is at the sole discretion of the adjudicator.
